Miami-Dade County Probate Division 

  • Beginning March 30, 2020, telephonic hearings will be held at the judges’ discretion.
  • The Circuit has obtained the necessary licenses for hearings via Zoom and will begin using Zoom for hearings when possible.  The Court is presently obtaining necessary equipment and training staff.   Once Zoom hearings are available, the Court will provide information accordingly.  The Court is working to update Notices of Hearing (that are automatically generated through Court Maps) to include remote hearing information.
  • The Court will contact the attorney for hearing instructions- DO NOT CONTACT THE COURT.
  • Hearings that were set via Court Map can be cancelled online via Court Map.
  • If an interested party has not or cannot be provided instructions for the remote hearing, the hearing must be cancelled or continued.
  • Parties are required to meet and confer prior to hearings.
  • Original documents, including Wills and Death Certificates, can only be sent via mail or Fedex. No walk-ins or couriers are currently permitted.
  • Updates are being provided through the “Proguard” list serve.  Additionally, once procedures are approved, the Court will be uploading changes to the Judicial website.
  • Any time limits set by judicial order and/or authorized by rule or statue that have a deadline falling between March 13, 2020 - April 20, 2020 (including annual guardianship accountings and plans) shall be extended 38 days from the original deadline. (See AO 20-04 dated March 25, 2020)
  • The Court is working on a method for submitting mental health orders via Court Map. In the interim, mental health orders must be mailed to the Court or otherwise submitted as directed by the Judge’s judicial assistant.
  • In incapacity matters, examining committee members will have 60 days (as opposed to 15) from the date of appointment to submit their report to the Court.
